Biography
Todd Ausherman began his legal career in San Diego at the University of San Diego School of Law. While in law school, he focused his study on Real Property Law and Labor and Employment Law. He was active in Moot Court, Mock Trial, and Team Negotiations achieving success in all, including being a member of the fist USD Negotiations Team to be invited to the ABA National Negotiations Championship.
In 2004, Mr. Ausherman began working for the Employee Rights Center focusing on Plaintiff's claims against their current and former employers. In this capacity, Mr. Ausherman represented numerous employees in the County of San Diego in front of the California Labor Commissioner in actions to collect unpaid wages and overtime. It was here that he learned the finer points of Wage and Hour Law as he directly represented employees paid hourly, by commission, and those who were misclassified as salaried employees under false pretenses of exemption to avoid overtime laws. Even early in his career, Mr. Ausherman successfully pursued favorable settlement outcomes using the California Labor Code as leverage for his clients in wage actions against their employers. Over this time he developed intimate knowledge of the California Labor Commission and the Division of Labor Standards Enforcement (DLSE) which administers and enforces the labor statues and regulations in the State of California. Because of his outstanding record of success, he was chosen by AFSCME Local 127 as union employee representative in litigation before the Civil Service Commission.
In 2006, he formed The Law Office of Todd P. Ausherman as a law firm specializing in Labor and Employment Law, while expanding his practice into Real Estate Compliance and general Contract drafting and negotiating. His experience in successfully representing employees in wage and unemployment claims made him a natural to assist employers in preventing employment problems before they arose. He has been hired by multiple California companies to implement employment procedures including the drafting of employment contracts, independent contractor agreements, employee handbooks, installing proper termination policies, branch manager agreements, structuring HR polices and engaging in representation of employers against former employees from unjust claims.
On the Real Estate side of things, Mr. Ausherman’s services have been used to navigate the turbulent regulatory climate that exists as a result of the financial crisis. He has been hired to implement best practices for mortgage lenders to maintain compliance in the areas of the SAFE ACT, TILA, RESPSA and the drafting, implementation and training of a proper Red Flag policy for a lending company with multiple branches to insure the safety of private information. He has also been hired by companies and individuals to review and draft contract provisions and to negotiate settlement terms in lieu of judgment.
He currently serves corporate and individual clients alike as well as engaging in consistent pro bono work for San Diego Courts. He is experienced in both the court room and in administrative hearings and has been successfully negotiating financial settlements since his first year of law school.
